Terms of Service

Effective date: April 1, 2026

These Terms of Service ("Terms") govern your use of BasinBaron, operated by BasinBaron ("we," "us," or "our") at basinbaron.com and map.basinbaron.com. By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use BasinBaron.

1. Eligibility

BasinBaron is intended for use by businesses and professionals in the oil and gas industry. You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization.

2. Subscription and Billing

BasinBaron is offered as a monthly subscription billed via Stripe. Your subscription begins on the date you provide payment information and continues on a month-to-month basis until cancelled.

• Billing occurs monthly on the anniversary of your subscription start date.
• Prices are listed in US dollars. We reserve the right to change pricing with 30 days' written notice to active subscribers.
• Promotional rates offered during beta or early access are locked for the duration of the original account. Rate locks do not transfer to new accounts.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial-month refunds are issued.
• Failed payments may result in temporary suspension of access. We will attempt to notify you before suspending your account.

3. Account

You are responsible for maintaining the security of your account credentials. Do not share your login with others. Each subscription covers one individual user. Team or multi-seat plans, if offered, will be governed by separate terms.

Notify us immediately at support@basinbaron.com if you suspect unauthorized access to your account.

4. Data Accuracy Disclaimer

BasinBaron displays well, permit, pipeline, facility, and operator data sourced from US government agencies including the Oklahoma Corporation Commission (OCC), Texas Railroad Commission (RRC), Environmental Protection Agency (EPA), and the National Pipeline Mapping System (NPMS). This data is provided as-is from public sources.

We make no warranties regarding the accuracy, completeness, timeliness, or fitness for a particular purpose of any data displayed on the platform. Public agency data may be delayed, incomplete, or contain errors outside our control. Do not rely solely on BasinBaron data for critical operational, financial, or legal decisions. Always verify data against primary sources when accuracy is essential.

5. Acceptable Use

You agree to use BasinBaron only for lawful purposes in connection with oil and gas industry work. The following are prohibited:

• Scraping, bulk downloading, or automated extraction of any data from the platform
• Redistributing, reselling, or sublicensing data or platform outputs to third parties
• Using the platform to build a competing product or service
• Attempting to circumvent access controls or security measures
• Sharing your account credentials with other individuals
• Using the platform for any unlawful purpose

Violation of these restrictions may result in immediate account termination without refund.

6. User-Created Content

Field notes, areas of interest, territories, and other content you create within BasinBaron belong to you. You grant us a limited license to store and display your content solely to provide the service. We do not claim ownership of your content and will not share it with other users or third parties except as required to operate the platform.

7. Intellectual Property

The BasinBaron platform, including its software, design, and brand, is our property. These Terms do not grant you any ownership rights in the platform. The government data displayed in BasinBaron is publicly available and not owned by us.

8. Account Termination

You may cancel your account at any time from account settings or by contacting support. We may terminate or suspend your account immediately if you violate these Terms, fail to pay, or if we determine your use poses a risk to the platform or other users.

Upon termination, your access to the platform ends. Your data will be retained for 30 days and then deleted, unless we are required by law to retain it longer.

9. Limitation of Liability

To the maximum extent permitted by law, BasinBaron and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the platform. This includes, but is not limited to, damages from reliance on inaccurate data, lost profits, or business decisions made using platform information.

Our total liability to you for any claim arising from these Terms or your use of BasinBaron is limited to the amount you paid us in the three months preceding the claim.

10. Disclaimer of Warranties

BasinBaron is provided "as is" and "as available." We make no warranty that the platform will be uninterrupted, error-free, or free of viruses or harmful components. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the extent permitted by law.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of BasinBaron shall be resolved in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to personal jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of BasinBaron after changes take effect constitutes acceptance of the updated Terms.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BasinBaron regarding your use of the platform and supersede any prior agreements on this subject.
